HB 341 - makes changes to OARRS requirements

As reported previously, recently passed legislation, House Bill 341, will impact the review requirements to which physicians and other prescribers must adhere when prescribing certain controlled substances.

Presently (as a result of HB 93 from the last General Assembly), physicians must check OARRS initially upon prescribing any controlled substance, then annually thereafter for the duration of the need for that medication.

The new language mandates checking OARRS initially, then no less often than every 90 days for Opiates and Benzodiazepines. This new legislation has been signed by the governor and will go into effect in April 2015.

It is important to note that as initially written, this more rigorous checking schedule would have also applied to stimulants, but successful advocacy by OPPA amended this provision. Thus checking OARRS when stimulants are prescribed will continue to be required annually (or more often, if indicated), as before.

The OPPA will remain vigilant regarding legislation that impacts the practice of psychiatry and the safety of our patients.
